1. Services
WixWebsites provides website design, development, setup, and maintenance services for Wix-based websites. Our services include:
- Custom Wix website design and development
- E-commerce setup and configuration
- Domain and email setup
- SEO optimization
- Ongoing maintenance and support
2. Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information about your business and requirements
- Provide necessary content (text, images, logos) in a timely manner
- Review and provide feedback on deliverables within agreed timeframes
- Ensure you have rights to all content you provide
- Make payments according to the agreed schedule
- Maintain your own Wix subscription after project completion
3. Pricing and Payment
Pricing
Prices for our services are as listed on our website or in your custom quote. Prices are subject to change but agreed prices will be honored for active projects.
Payment Terms
- 50% deposit required to begin work
- Remaining 50% due before website launch
- Maintenance plans billed monthly in advance
- Late payments may incur fees and project delays
Refunds
- Full refund if work has not yet begun
- Prorated refund based on work completed if project is cancelled mid-way
- No refunds after website launch
4. Project Timeline
Estimated timelines are provided based on typical project scope. Actual delivery depends on:
- Timely provision of content and feedback by client
- Scope remaining as originally agreed
- Number of revision rounds
We are not liable for delays caused by client response times or scope changes.
5. Revisions
- Starter Package: 2 rounds of revisions included
- Professional Package: Unlimited revisions
- Enterprise Package: Unlimited revisions
A "revision" is defined as a set of changes to the existing design. Requests for major structural changes or new features may be considered scope changes and billed separately.
6. Intellectual Property
Your Content
You retain ownership of all content you provide (text, images, logos, etc.). You grant us a license to use this content for the purpose of completing your project.
Our Work
Upon full payment, you own the final website design and content created specifically for your project. We retain the right to:
- Display your website in our portfolio
- Reference you as a client
- Reuse general techniques, code patterns, and design elements
7. Wix Platform
Your website will be built on the Wix platform. You acknowledge that:
- Wix is a third-party service with its own Terms of Service
- You are responsible for maintaining your Wix subscription
- We are not responsible for Wix platform issues, outages, or changes
- Wix features and pricing may change at Wix's discretion
8. Maintenance Services
Our maintenance plans are month-to-month and can be cancelled with 30 days notice. Maintenance includes:
- Content updates (text, images, products)
- Performance monitoring
- Security checks
- Priority support
Maintenance does not include major redesigns, new features, or third-party integrations, which are billed separately.
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for services
- We are not responsible for lost revenue, data loss, or business interruption
- We are not responsible for third-party services (Wix, payment processors, etc.)
10. Warranties
We warrant that:
- Services will be performed professionally and competently
- Your website will function as demonstrated at launch
We do not warrant:
- Specific business results, traffic, or sales
- Uninterrupted or error-free operation
- Compatibility with all browsers or devices
11. Termination
Either party may terminate services:
- With 30 days written notice
- Immediately for material breach
- Immediately for non-payment (by us)
Upon termination, you will receive all work completed to date, and remaining payments become due.
12. Dispute Resolution
Any disputes will be resolved through:
- Good faith negotiation
- Mediation if negotiation fails
- Binding arbitration as a last resort
13. Changes to Terms
We may update these Terms from time to time. Continued use of our services constitutes acceptance of updated Terms. Material changes will be communicated via email.
